Jessica Taylor 13, February 2012 AP English Mrs. Mercer Self-Sufficiency and Individualism Can Harm a Community Henry David Thoreau goes to the woods to live away from duties and to live a life of leisure. He moves far away from any method of communication, such as the post office. He wishes to live independently and self-sufficiently. The quote â€Å"I went to the woods because I wished to live deliberately, to front only the essential facts of life†¦and not, when I came to die, discover that I had not lived. † He summarizes his reasons for living in the woods in this quote.Thoreau wants to live deliberately; to choose his own course and have no one else influence his life. He doesn’t want to get old and look back and realize that there are things in life that he wanted to do, that he has never done. If everyone in a community lived by the virtues of individualism and self-sufficiency, then there would be no community. In a community, everyone contributes somethin g. Individuals in a community work together, in order to solve problems and issues facing the community. Such as, if there has been a terrible natural disaster, communities work together to repair the damage.If the damage is more extensive in some areas than others, then the individuals of that community can work harder to restore it. If everyone in a community lived by the virtues of individualism and self-sufficiency, then in times of crisis or suffering, there would be no sense of community where people helped one another. Also if a community lived by these virtues, then there would be no trust. In order to gain or build trust, there has to be some sort of connection between individuals. In Thoreau’s self-sufficient world, there was no communication.If a person held the virtue of self-sufficiency, this may make other individuals feel offended. People would feel offended because today’s world is all about communication. If an individual blocked out other people and d id not allow them to help him/her, then this might make the other individual feel as if they were not beneficial. Instead of being a community, it would be more of a rivalry between individuals. There would be no trust or companionship. In times when individuals would need each other’s help; there would be no sense of alliance.Everyone would be against one another, because everyone would feel as if each other were untrustworthy. In the United States, we are one giant community; there are many communities within the major one. In times of war or battle, we stand together. Above all, the citizens in the U. S are able to come together to fight the battles when needed. If every citizen in the U. S lived by the virtues of self-sufficiency and individualism then there would be no U. S. in times of war; there would be no army. In an army you must work together to find the best solution to the problem, there has to be teamwork and trust.In a self-sufficient world, everyone would want to do things in their own way, and in return this would cause chaos. A community is a beneficial factor, without it we have nothing. Yes, being self-sufficient can be a helpful virtue, but in the condition of the community it is one virtue that can destroy the community. If there was no sense of an alliance, there would be no way to survive a natural disaster or fatal event. A community can strive and recover from a setback, whereas, if an individual was self-sufficient, then this would be much more difficult.

An offer must give a clear indication that the offeror intends to be bound by those terms as soon as they are accepted by the offeree. An offer may remain open until the specified time has been completed. Anthony told Joyce to respond to the offer within a specified time which was Wednesday mid-day. After that time, the offer would have been terminated. According to the English legal system, other circumstances in which the offer will terminate are rejection of the offer, a counter offer made by the offeree, death of the offeror or offeree and withdrawal of the offer (Schulze, 2007, p. 321). In this case, Anthony has withdrawn from the offer th rough sending a letter which Joyce received after posting the acceptance. Under the law, withdrawal of the offer must be communicated to the offeree. The withdrawal of an offer is known as the revocation of the offer. The case of Payne v Cave (1789) established the principle that an offer could be withdrawn anytime before it is accepted. There are many rules that apply to the withdrawal of offers. One of the main rule is that the withdrawal must be communicated which means that the offerors must notify the offeree that the offer is revoked (Young, 2009, p. 87). This rule was established in the case of Byrne & Co v Leon Van Tienhoven (1880) in which the defendants were a company based in Cardiff. They posted a letter on 1st October to New York making an offer to sell 1,000 boxes of tinplates to the plaintiffs. When the plaintiffs received the letter, they accepted it by telegram. However, in the meantime, the defendants wrote another letter to revoke their offer but the letter was re ceived by the plaintiffs later. The court held that a binding contract existed between the two parties as revocation would only take place on communication but acceptances take place as soon as they are posted. Anthony posted his revocation by post and it was received by Joyce after posting the acceptance. This means that the offer had not been revoked and Anthony was still under the circumstances of the offer and must be fulfilling his promise despite the losses it would cause to him. Thus, the offer has not been revoked because acceptance was already posted. If the acceptance would not have been posted by Joyce, the offer could have been revoked because the specified time given for the offer was still valid. Thus, an offer has been made and accepted as well. An offer is revoked only if the revocation is communicated to the offeree but the acceptance is made as soon as it is posted. The contract law establishes that acceptance of an offer is when the offeree has unconditionally acc epted to all terms of the offer. Acceptance can be oral or in writing, but at times acceptance can be done by an act such as delivering goods in a response to the offer. Acceptance does not take effect until it is communicated by reasonable means. Relevance of Lead Apron in Medical Imaging Profession Introduction Lead aprons are available in the healthcare facilities to provide protection from unnecessary exposure of X-radiation to the patients and workers during radiology procedures usually done for diagnostic purposes. Body is shielded by the protective garment called lead apron from the harmful radiation during the medical imaging. Lead apron is found to be effective in protecting from radiation exposure only when it is worn properly. It is used in a safe and properly inspected environment (Lead Apron Policy, 2012). Protective aprons of 0.25mm lead are worn, while performing fluoroscopy whose body is exposed to 5mR/hr or more. Individuals expected to wear lead aprons or similar radiation protection instruments must inspect these instruments visually for any signs of damage before using them (Lead Apron Policy; California code of regulations, 2012). Principles of Lead Apron Advantages of lead apron It is observed to be effective and appropriate in protecting 95 percent of 80 kVp X-rays. As lead apron causes pain and stress to the back muscles back strain is avoided by wearing a skirt apron around the abdomen. In performing fluoroscopic procedures, wearing lead apron of lead equivalence 0.25mm to 0.5mm is found to decrease scattered X-rays by 95 percent. A thyroid collar is used along with lead apron and it is not required in the case of imaging patients. Every occupation worker exposed to fluoroscopic units higher than 5mrem/hr should wear lead apron. The dose rates that are higher than 5mrem/hr are measured within six feet of the table and it includes the place occupied by fluoroscopist (Lead Apron Policy, 2012). Disadvantages of lead apron Lead apron is not sufficient for protecting 111In or 131I. No shielding is provided for the patients by the lead apron for 137Cs or 131I therapy. In these patients, heavy portable shields are available. Shields are provided for brachytherapy patients in the radiation oncology department. Shields for radioactive iodine therapy patients are provided by health physics department (Lead Apron Policy, 2012). Inventory policy and lead apron inspection According to the joint commission standards, annual inspections have to be performed on the medical equipment by the healthcare organizations. Lead apron inspection and inventory are performed by Stanford hospital Clinics, Lucile Packard Children’s hospital and VA Palo Alto Healthcare system. Some of the recommendations in the apron inspection policy are looking for sagging and deformities or any visible damage, performing annual tactile and visual inspection and holes and cracks are identified by radiography and fluoroscopy. It is important to use manual settings and low technique factors during fluoroscopic examination. It is not recommended to use automatic brightness control as it will drive up the high voltage and tube current, which might result in exposure of unnecessary radiation to the operator and the wear (Lead Apron Policy, 2012). Lead apron is discarded, if the inspection reveals that there is a defect larger than 15 sq. mm on the apron parts shielding an organ or if there is any defect larger than 670 sq. mm along the seam or in the back of the apron and in thyroid shields with defects larger than 11 sq. mm (Lead Apron Policy, 2012). How can the affected technical personnel be protected from the radiation? It is not necessary for the technical personnel to stay closer to the patient in the case of radiography, general computerized tomography and mammography. Staying distant from the patient will prevent the personnel to receive the scattered X-rays from the patient. Structural shielding can also be placed in between the patient and the personnel to avoid the X-rays reaching the personnel. When the personnel are closer to the patient in fluoroscopic examinations as well as in image guided interventions, distance and structural shield will not be able to stop the scattering of the X-rays. In such cases, protective clothing like aprons, spectacles, table- mounted protective curtains, ceiling suspended protective screens and thyroid shields have to be used by the personnel (JL Heron et al., 2010). Based on the lead equivalence and X-ray energy, an apron will terminate 90 percent or more of the incident scattered radiation. The protective aprons are available in various thicknesses and shapes starting from front-only apron to a full coat. The front-only apron will be effective, if the person wearing it is facing the source of the scattered radiation (JL Heron et al., 2010). Radiological workloads differ for various specialities. The concerned protective tools required by a particular department are specified by a radiation protection expert or a medical physicist. The person with high workload in the cardiac laboratory must utilize all the protective tools, while a person in the orthopedic suite might require a front-only apron. If the person is working closer to the patient during imaging and wears an apron, a dosimeter that is fixed under the apron will estimate exposure of rays to the shielded portion and will not properly estimate the exposure of organs and tissues present outside the apron. Two dosimeters fixed inside and outside of the apron will give a good estimate of the effective dose to be used (JL Heron et al., 2010). How far are the lead aprons protective against ionizing radiation? Research studies were done to analyze the qualitative and quantitative aspects of lead aprons with the help of various methods. Eighty five lead aprons were collected from various departments in the hospital and from the district polyclinics where radiation exposure was present. They were collected and brought to the radiology clinic of the hospital to assess their protective nature. Aprons were identified based on the number of years they were used by the personnel, the units from where they have been obtained, number of personnel by whom they were worn, the model, the material by which they are made of and the thickness of lead in the apron (O Oyar and A Kislalioglu, 2012). X-rays were delivered such that 35X35 cm wide area of the lead apron is exposed to the radiation. There was 110cm distance between tube focus and lead apron. The images on the plates exposed on the back of the apron are transferred to films and these films are later evaluated with the help of scratches, cracks, rips and defects that might be present on the lead aprons (O Oyar and A Kislalioglu, 2012). As per the standard method, holes greater than 2mm diameter and cracks longer than 4mm were considered as destruction criteria. The aprons exposed with the same criteria were allotted for dosimeter testing by the ratio of ray absorption. The absorption features were assessed using two tests such as scattering X-rays on the apron directly and indirectly. In both direct and indirect methods, same parameters were used for estimating the radiation by fixing the dosimeters in the front as well as at the back of apron. The doses were evaluated and the absorptions were calculated. The base for apron measurements, ten protective aprons with radiation permeability and various lead thicknesses, Turkish standards institution documents approved quality and durability were chosen. Aprons that were not used before were used as controls. The analyzed aprons were measured individually and the results were noted down (O Oyar and A Kislalioglu, 2012). The results have shown that lead is the material used for radiation protection. Among double-sided lead aprons, skirt-vest lead aprons and frontal protection lead aprons, the frontal protection apron is mostly used. Evaluating the cleanliness of the aprons, 23 were clean and the remaining were either little or too dirty. No significant association was observed between the apron destruction criteria and apron cleaning methods. Evaluating the overall condition of the apron, 45 aprons were in good condition and the remaining was either slightly or extremely worn out (O Oyar and A Kislalioglu, 2012). Highest radiation permeability was observed in extremely worn out aprons and in aprons that were in decent condition. The apron that was worn out very little is least permeable compared to the extremely worn out and those in good condition. Among 58 aprons, 26 were destroyed due to cracks, 14 due to tears and holes, and 18 due to tears. In all these aprons, radiation permeability was more than normal. No significant relationship was observed between radiation permeability and internal structural features of protective lead aprons or total number of apron users. Destruction criteria were significantly associated with apron models. Frontal protection lead apron model was destroyed most often (O Oyar and A Kislalioglu, 2012). The exposure dose was analyzed as 996.1 micro grays on average. For 0.25mm lead aprons, the exposure dose was 51.59 micro grays on average. For 0.5mm lead aprons, exposure dose was 9.891 micrograys on average. Among the indirect measurements, scattered radiation value measured at the distance of 50cm was 2.1 R/h. The indirect radiation measured for 0.25mm lead equivalent apron was evaluated as 1.85 micro grays and that for 0.5mm lead apron was evaluated as 1 microgray (O Oyar and A Kislalioglu, 2012). Some folds and sags were observed on the protective layers of the aprons. Significant radiation permeability difference was not observed between folded aprons and non-folded aprons. The protected dose was measured as 60.20+/-22.96 micro grays for unfolded 0.5mm lead equivalent aprons. The protected dose was 50.36+/- 22.96 micro grays for folded 0.5mm aprons, 50.36+/- 22.96 micro grays for 0.25mm lead equivalent aprons. For folded 0.25mm aprons, the dose was evaluated as 46+/-19.05 micrograys (O Oyar and A Kislalioglu, 2012). Discussion The aprons that were used for protecting against scattered ionizing radiation are made using lead embedded in rubber fabric, which is the mixture of lead-rubber or lead-vinyl. These aprons possess the thickness of 0.25mm to 0.5mm. They are costly and are of great importance when used and stored properly. It is an expert view that these aprons are not often preserved and taken care of, and they are folded carelessly, which could be reasons for them to lose protective ability. The research study first done in Turkey by Oyar and Kislalioglu in a quality certified hospital with a control standard and the measurements were taken for quantitative and qualitative radiation exposure values from the protective lead aprons (O Oyar and A Kislalioglu, 2012). It is estimated that 0.5mm thick lead aprons will be able to absorb higher than 90 percent of irradiation at the dose of 150kVp. The similar apron must be able to absorb higher than 99 percent of the irradiation dose at 70kVp (Radiation issue notes, 2008). In some of the studies on absorption ratio of protective aprons, research has revealed that either indirect or direct X-ray absorption ratio of aprons must be measured separately (Christodoulou EG, 2003; Muir S, 2005). Though the actual purpose of lead apron is to protect against indirect X-radiation, in the study done by Oyar and Kislalioglu, the results from direct radiation exposure measurements might be more beneficial in the evaluations due to wider spectrum width. Direct measurements were accepted to provide better results from the evaluations of ray absorption by the lead aprons. If lead aprons are not stored properly, they will lose the protecting quality and radiation protection ability is reduced for that apron gradually. The storage racks for lead aprons are available in various styles and configurations to fulfill the necessities of the medical facility (Universal medical, 2014). Medical professionals interested to wear lead aprons or other radiation protection instruments must have their protective garments checked well for any damages like rips and tears, cracks in the lead lining and sagging lead before their use. Proper lead apron storage will extend the apron life by preventing the lead lining damage and the external fabric damage. Lead aprons have to be hung by the apron hangers instead of folding them. Damages can result even if the apron storage is incorrect. Organizing the aprons properly will make the tracking process and the State or Joint commission inspection easier. Inspection of aprons will improve their organization (Universal medical, 2014). Usually, it is a common practice to place half apron at the back of the patient during the erect chest radiograph to protect the patient from radiation dose from tube leakage and room scatter. Most of the back scatter from the patient is a part of the internal scatter that might affect gonads and other tissues. Half apron will have least effect from patient dose and they make the patients to realize that precautions taken will protect them from unnecessary exposure (Lead garments (Felmlee JP et al., 1991). Use of lead shield is made mandatory for gonadal protection in most of the X-ray departments. If the gonads are present nearer the primary X-ray beam, gonadal shielding is very much necessary. Even if the X-ray field is not near the gonads, gonadal shield is given as the deterrent for the pediatric patients. According to the national recommendations associated with shielding of patients from radiation exposure during imaging, lead aprons were not significantly reducing radiation dose. Dental radiation policies indicate that implementing all the routine precautions will not demand the use of lead aprons on the patient. Later, lead aprons were considered as reducing the radiation dose, from several diagnostic X-ray procedures, to the reproductive organs. Radiation can cause germ cell mutations which might be carried to the next generations. Lead aprons have a precautionary role in reducing the radiation dose (Felmlee JP et al., 1991). The protective clothing worn by the radiographers consists of lead and other metals like tungsten, barium, tin and antimony. The clothing will help in shielding the personnel from radiation. The metals in the radiation protective clothing are equivalently mixed with polyvinyl chloride or synthetic rubber. Sheets of nylon fabric coated with urethane are placed against the side of lead impregnated rubber in between the two and five sheets of metal-impregnated rubber or PVC. These materials are cut as a pattern and sewn to create a protective garment. The manufacturers of these garments alter the sheet number, metal percentage, rubber or PVC grade and the metal mixture affecting the durability, weight, flexibility and radiation absorption efficiency (Felmlee JP et al., 1991). Normally, lead apron is not used for the patients undergoing medical procedures associated with radiation as the area of interest will not be protected. Lead aprons are mostly recommended for those who are exposed to the radiation by being in their occupation. If the apron is worn between the direct X-ray beam and the patient, then 90 percent of the rays are prevented from entering the patient’s body. Therefore, it is not practical for putting apron on the body part that is of interest to the physician (Felmlee JP et al., 1991). As per the standards put forward by the Joint Commission, healthcare organizations have to perform inspections on the medical instrumentation along with the lead aprons. Health department of State also should have a regulation for inspecting the lead aprons. Titanium is used as the shielding material in the titanium aprons. Other materials used in the aprons are barium and bismuth. The shielding properties of the material can be assessed by their mass coefficient and linear attenuation coefficient. Mass attenuation coefficient for the elements is found by physical reference data website of National institute of standards and technology (Felmlee JP et al., 1991). Conclusion As the X-ray imaging is being used continuously all through the world, this technology has created new challenges for occupational protection for the medical staff from radiation. In many of the X-ray procedures, it is necessary for the medical staff to stay closer to the patients, while performing the imaging. Therefore, there is potential for the staff to get exposed to the radiation and it has become extremely important for them to implement certain restrictions to prevent themselves from radiation exposure. Lead aprons decrease the radiation dose to the gonads from various diagnostic X-ray procedures. Radiation can cause mutations in the reproductive cells, which might be transferred to the future generations. Protective clothing worn by the radiographers consists of lead and other metals, like tungsten, barium, tin and antimony. These metals are mixed with polyvinylchloride to create a protective garment. The number of sheets, metal percentage, rubber grade and metal mixture in different ratios will show impact on the flexibility, durability, radiation absorption, weight and efficiency of the protection sheets. Lead aprons are highly effective in absorbing diagnostic X-rays to the body parts shielded by the apron. The effectiveness is energy dependent and averages to about 90 to 95 percent. Irrespective of whether the radiation personnel have worn the lead apron or not, the exposure allowed on the body is ruled by exposure limits. The primary dimensions described as peoples fundamental characters, such as age, ethnicity, gender, physical abilities, race and so on. The secondary dimensions refer to persons self definition via educational background, income, marital status, religious beliefs etc. Both of the dimensions may hold the same status of daily cultural impact on a multicultural organization. Cultural diversity is a specific area in diversity, which focus on peoples characters labeled culturally, including gender, age, ethnicity, race, and also lifestyle, immigrant status and language facility. Cultural diversity management is aimed at taking advantage of staffs different cultural background to increase their motivation and creativity, further to bring a successful close to strategy. Increasing diversity management can be a double-edging sword. Although the awareness of cultural diversity in workforce is becoming day by day better recognized by organizations, it is often effectively limited due to the passively abidance of legal compliance and human rights protection. Based on theory and research, inappropriate implementations can create barrier to high performance. Firstly, diversity can increase misunderstanding and conflict among employees from different cultural background. Compared with more homogeneous group, the former group may experience lower levels of social attraction and competitiveness. Secondly, too much diverse leads to harassment and discrimination behaviors. As different managers hold different opinions of managing cultural diversity, different approaches can be implemented. One of the simplest methods is avoiding diversity. However the reality is for most multinational organizations, it is not feasible. How to take advantage of cultural diversi ty without suffering enormous disbenefit is the main issue faced by employers. Another side of the diversity sword is that well managed diversity can catalyze the performance of organizations at different aspect, which means a value-added activity. First of all, well implemented approaches create an image of fairness and respect for all people which is an ideal working environment for staff. These terms are listed in formal statements of policy in every organization in the world, but unless the company has effective and ongoing strategies, those clauses are just another meaningless and hopeful fairy tale without princess. Whats more, employees from different cultural background diversify solutions of problems, decision making, skills and allocation of resources (Gardner Plamer, 1992), which can provide a larger pool of ideas and experiences. The organization can draw from that pool to meet Business strategy and the customers needs more effectively. And also provide individual talents, creativity and experiences (e.g. languages, cultural understanding) from div erse culture. This may allows a company to provide a global service to customers and also improve their marketing strategies. In addition, opinions from diverse cultural background enhance critical analysis in decision-making groups. In a series of research studies, Charlene Nemeth found that groups subjected to minority views were better at critically analyzing decision issues and alternatives than those that were not. Model for Cultural Change Figure attached reveals a model for organizational implementations to tackle the impacts of diversity (Taylor Cox. Jr , 2001). Every element from this model should be considered as an effective organizational change. Following the flow of the arrows suggests, every element is influenced by the diversity and continually interacts with each other in the process of self learning. Leadership Leadership is a behavior that establishes an objective for improvement which provides a sense of urgency and importance for the vision. The orientation of change is also called vision. Meanwhile it also generates motivation of others, and brings an ideal environment for achievement of the vision. At the same time, a leader should be involved in vision, establish the adequate organization design and integrate the diversity management with the companys business strategy. It is absolutely the most essential element for change. As its vital role of a diversity change effort, leadership is on the top of the list while implementing diversity. Leaders are those who have influence with other members within the organization, such as CEOs, heads of unites of organizations or divisions, HR staff members with diversity assignments and head of labor unions. In order to achieve fully effectiveness of the implementations, the change should satisfy these conditions: (1) leadership starts at the executive; (2) it takes generations of administration to make the effort work, and (3) leadership should present directly without delegate. First of all, to be fully effective, leadership on diversity must start at the top. A change of presidents would produce a noticeable slow-down in progress toward the goals that were laid out for diversity excellence. Although other members of the leadership team below the CEO level, including the head of the HR function and several engineering managers, continue to work on the diversity change effort, the effort lost momentum that was never recovered. Secondly, it takes many leaders to achieve the final goal. In Alcoa, for example, a remarkable progress of cultural diversity owe to leaders at different levels of management chain. In 1999, the executive vice president George Bergeron included an assessment of progress on the diversity goals of the company as part of the incentive compensation formula for all managers reporting to him. Partly as a result of this action, the business units under his authority were all active in working the change model and achieved remarkable progress in the first year of work (Taylor Cox, 2001). Eventually, unless there is someone taking the responsibility of making change, the effort made to diversity would doom to failure. Research Measurement Research is a method of collecting data by which people solve problems about environmental element or phenomenon (Taylor Cox Jr, 2001). In the context of organizational effort on diversity, such problems are specified as: (1) gender distribution which regarded as a question about element and (2) whether an employees job performance is influenced by age is categorized as the relationship between elements. Measurement indicates approaches to record the effectiveness of diversity change. This part of model explains several questions of using data, including how to create criteria to implementation with data, how to use data to improve awareness of diversity, how to evaluate the environment for diversity and how to critic progress has been made. Take Alcoa as an example, there was a significant meeting of managing department in both business unit and resource unit, which regarded as a watershed event in leader commitment. Data presented on diversity of this meeting based on surveys and interviews at around five different locations of the organization. Some quotations were wrote down during the interviews with employees from every grade of job, and written on board and showed around the meeting room. Then the leaders walked around and read the messages, some of which approved to run counter to companys elemental values and policies. This is just a simple experience of using internal data, which became a motivate activity for forming support of the diversity effort at A lcoa. As is shown above, research and measurement are fundamental to the diversity management process, while using data to act on improvements means using data to increase commitment, enhance training, diagnosing the climate for diversity and measure progress (Taylor Cox Jr, 2001). Education Education refers to trainings and practices of any change effort. As a core feature of way to diversity, approaches of learning must diversified to fulfill its original purpose. Employees showed great conscious of diversity during the training period, many of which would not last long after training procedure. In order to deliver a remarkable education on diversity and collect better return from investment on diversity training, an educating design should based on certain ingredients: content, format and logistics, participants, and facilitation. Firstly, the content of training on diversity should be critical hence multidimensional. Each dimension is specified into different substance, for instance, to specify the required subtopics, to indicate the relationship among topics and to illustrate the type of the content. Secondly, the format and logistics of a diversity education are determined by time and approaches of the training. The effectiveness of training is not only influenced by the length of training period, but also affected by the way of using time. For example, instead of a one-day-six-hour exhausting boredom, a two hour well sequenced training program of three days is more effective and efficient. Thirdly, in the participant perspective, how large the trainee group, how many fields and levels of the employee, and the preparation for the participants should be considered before education. United States vs. Carlos Alfonso Moreno On July 12, 2004, Carlos Alfonso Moreno appeared before the United States Court of Appeals, Tenth Circuit. He brought before the court an appeal challenging the district court’s calculation of his sentencing under the United States Sentencing Guideline. The panel determined after reviewing his case that an oral argument would not be necessary. They were able to look at the details of his case and make their decision.   Ã‚  Ã‚  Ã‚  Ã‚  Mr. Moreno was charged in district court with various drug offenses and with being a felon in possession of a firearm. He entered a guilty plea to possession with intent to distribute more than fifty grams of a substance containing a detectable amount of methamphetamine and possession of a firearm by a prohibited person In the pre-sentence report recommending Mr. Moreno's sentence, the Probation Officer added a point to his criminal history score as a result of September 2001 convictions for driving with a suspended license and for unsafe turning or stopping. For this earlier offense, Mr. Moreno was sentenced to six months in jail, with all but five days suspended, and six months of probation. The Probation Officer justified the addition of this point by citing the sentencing guidelines, which direct that sentences for less than sixty days should be given one point. The Probation Officer then determined that Mr. Moreno's criminal history points totaled ten, placing him at the bottom of criminal history category. The district court agreed with this result and calculated Mr. Moreno's total adjusted offense level to be twenty-five. The court subsequently sentenced Mr. Moreno to 100 months in prison, which is at the bottom of the 100 to 125 month range for an offense level twenty-five and criminal histo ry category 5. On appeal, Mr. Moreno asserts the district court erred by adding a point to his criminal history for the earlier sentence. Absent the additional point, Mr. Moreno would have been in a lower criminal history category and hence could have been subjected to a shorter sentence. However, because Mr. Moreno failed to raise an objection before the district court regarding the additional point for the September 2001 sentence, his sentencing stood.

Poverty and Nutrition in America Essay -- Low-Income and Food Insecure

For most Americans, the word poverty means insufficient access to to housing, clothing and nutritious food that meet their needs for a healthy life. A consequence of poverty is a low socioeconomic status that leads to being exposed to poor nutrition. Since food and dietary choices are influenced by income, poverty and nutrition go hand in hand. There are many important factors that threaten the nutritional status of poor people. The number one factor is not having enough money to buy food of good quality and quantity. Not having enough money can have a profound impact on the diets of low-income people. Limited financial resources may force low income people to make difficult decisions about what kind and how much food to buy. Limited financial resources often lead to food insecurity. According to Gundersen, Waxman, Engelhard, and Brown (2011) food insecurity is the lack of access to healthy food in quantity or quality. Poverty is regarded as the major cause of food insecurity. A household food security depends on access to food. America has access to good healthy food. However, a family too poor to buy them do not enjoy food security. Rosenbaum and Neuberger (2005) report that each year the number of people using government food assistance programs grows. â€Å"Food stamps are targeted to those with the greatest need for help in purchasing food†¦ [and] helps to lessen the extent and severity of poverty (Rosenbaum and Neuberger 2005)†. The Church of Latter-Day Saints: Mormonism

The topic of my research paper is the Mormon religion. Particularly the original form of the religion as the Church of Jesus Christ of Latter-day Saints. With this paper I will answer the following questions as to where did the religion started, who were/are the main leaders and places of worship for the religion, are there any divisions or sects that are associated with the religion, how has the religion changed over time, and what does the future hold for this religion? To find my answers I searched many online articles, books, and magazine articles.I found that the Mormon religion is a lot more complex than I believe many people think it is and there are many misconceptions made about the religion. Mormonism is not only a religion but a way of life for the people that call themselves LDS (Latter Day Saints). The religion was founded by Joseph Smith Jr. and has devout followers worldwide. â€Å"Mormonism, is the pure doctrine of Jesus Christ; of which I myself am not ashamed. â₠¬  This quote by Joseph Smith summarizes how true and pure the follows of this religion believe it is.With this paper I will give a brief history of the Mormon religion and try to address key issues and topics surrounding this controversial religion. Joseph Smith established the Mormon religion in 1830 after a vision from God. He said that while praying in the woods God came to him in a vision and instructed him to start a new true religion. When God appeared, Joseph asked him what was the right religion to follow. â€Å"The Lord answered that he must join â€Å"none of them, for they were all wrong† and â€Å"all their creeds were an abomination in his sight. He said that they had a â€Å"form of godliness,† but they denied â€Å"the power thereof† (Ingleton,2005). With this new found understanding and the power of God’s words Joseph started The Church of Jesus Christ of Latter-day Saints. The church was founded with just six followers to start; many of which were Joseph’s family members. (Ingleton, 2005) Three years after the First Vision, God sent Joseph a messenger to instruct him. The messenger, Moroni told Joseph of gold tablets that had the word of the Lord, the everlasting gospel written on them they were buried in the hills.Joseph found the templates and began translating them. The finished product would be known as the Book of Mormon. (Joseph Smith, Jr. Wikipedia) Joseph used the Book of Mormon as a secondary Bible. He still believed the words of the Bible but this was what came after the times described in the Bible. He did believe although that this was a better version of the Bible from God. He states, â€Å"I told the brethren that the Book of Mormon was the most correct of any book on earth, and the keystone of our religion, and a man would get nearer to God by abiding by its precepts, than by any other book. (McConkie, 1959) He began to preach to people using the Book of Mormon as his basis. Many were not happy with Joseph’s ideas and they drove him and his people out of the east. Joseph claimed the only place the Mormon faith would survive is in the mountains. He said he had a vision of a place they would call Zion and he would lead his people there. With his teachings he drew the attention of a man named Brigham Young. Brigham Young studied the Book of Mormon for two years before he was convinced that this was the one true book and religion.Therefore, after Joseph Smith died Brigham felt compeled to carry out the vision of Joseph Smith. Young was the one who lead the people to find the Zion in what is now Salt Lake City, UT in search of religious freedom. This is where the Mormon religion has been based since July, 1859 when the settlers petitioned for statehood. (Joseph Smith Jr. Wikipedia) Joseph Smith had visions of a Holy Temple that would be built at the Zion where his people could worship without religious persecution and God had commanded he build the House of God. Fo ur days after entering the Salt Lake Valley on 24 July 1847, Brigham Young designated where the temple would be built, and on 6 April 1853, he laid the cornerstone of the temple foundation.That event marked the beginning of a long construction process. Work on the temple stretched from years to decades until finally, 40 years after it was begun, the temple was completed and dedicated on 6 April 1893† (Abanes, 2003). The Church now has many temples, or Houses of God. The Latter Day Saints view building these temples as the fulfillment of the prophecy found in Malachi 3:1. Abanes, 2003) â€Å"As of Dec 2008, there are 129 Temples in operation, 9 temples under construction, and an additional 8 temples announced for construction in the near future. These figures give a grand total of 146 Temples that will be or are in operation in the near future† (Abanes, 2003). The temples differ from the church meeting houses that are used for weekly worship. They are only used for speci al occasions such as endowment ceremonies and marriages to be sealed. A weekly meeting house or church can be found every few blocks. There is one church or meetinghouse for every ward.A ward consists of 200 to 500 active church members that live within a reasonable distance from the meetinghouse (Abanes, 2003). The Church of Jesus Christ of Latter-day Saints (LDS) is technically considered a type of Christian religion. Mainly this is because they believe in God and his son Jesus Christ. Beyond that their beliefs differ and the LDS follow different religious leaders. There are many prophets of God, such as Joseph Smith that the church looks to for guidance. These prophets also serve as Presidents of the Church and direct the affairs of the Church.There have been sixteen church Presidents since the beginning of the LDS Church. There isn’t a term to their presidency and many remain President until their death. The current President is Thomas S. Monson and he has served as the C hurch President since 2008 (Mormonism, Wikipedia). There are many sects associated with the original Church of Christ of Latter-day Saints. Before migrating to the Utah Valley the church split into a few different groups because they didn’t believe in some of Joseph Smith’s practices such as plural marriage. The largest of these, the Community of Christ (originally known as the Reorganized Church of Jesus Christ of Latter Day Saints), was formed in Illinois in 1860 by several groups uniting around Smith's son, Joseph Smith III.Most denominations existing today that follow the teachings of Joseph Smith, Jr. have some historical relationship with the movement. † There were five main denominations of the LDS Church which include, The Church of Jesus Christ of Latter-day Saints. But none of these have caused quite the stir as the most recent denomination that split from the Church of Christ of Latter-day Saints in 1935. FLDS, Wikipedia) The split occurred largely bec ause of the LDS Church's renunciation of polygamy and its decision to excommunicate practitioners of plural marriage, who would not discontinue the practice. The current headquarters can be found in Eldorado, Texas where the FLDS Church built their temple. The FLDS have been in the news in recent years surrounding the controversy of the polygamy practiced by their members. Not only were they marrying multiple women but they would marry women that were under age.The youngest bride of the leader of the FLDS was just 14 years old. As you can imagine, this caused many people to look upon the Mormon faith in a negative way. Polygamy is no longer practiced within The Church of Jesus Christ of Latter-day Saints or its other sects. The only group to follow this way of teaching that stems from Joseph Smith are the FLDS. (FLDS, Wikipedia) This is just one of the changes that have taken place over time within this religion. The LDS religion as we know it today is very widespread due to the inc reasingly large numbers of missionaries.Every boy at the age of eighteen is encouraged to go on a mission trip for two years. This makes up a large portion of the missionaries. Also now that there are temples it is favorable of the LDS member to be married and sealed together in the temple. Tithing is a big part of the Church as well. You are to give one-tenth of the money you earn to the church to help build up the church and spread the Lord’s word (Oakes,1994). The changes that have taken place in the church are all for the benefit of a growing religious community. The future of this religion looks bright.On the cover of the November, 2007 issue of US News & World Report was an article about the Church of Jesus Christ of Latter-day Saints and the growing popularity of the Mormon religion. One of the article’s main points is the remarkable growth of the Utah-based religion, and the interesting observation that the emergence of Mormonism represents the first world-wide invention of a new religion since the prophet Mohamed gave the world Islam. Among the article’s more remarkable statements is a prediction about the growth in Church membership.It says: â€Å"If current trends hold, experts say Latter-day Saints could number 265 million worldwide by 2080, second only to Roman Catholics among Christian bodies. Mormonism, says Rodney Stark, professor of sociology and religion at the University of Washington, â€Å"stands on the threshold of becoming the first major faith to appear on Earth since the prophet Mohammed rode out of the desert† (Sheler, 2007). With this prediction I feel it is safe to say that this may become one of world religions that students in the future will study more closely in their World Religion classes.

Native American beliefs are deeply rooted in their culture Essay

They didn’t have one single religion, but they did have many beliefs. They believed in a mysterious force in nature and in spirits that were higher than human beings and influenced their lives. People depended on them when they searched for food or when people were ill. They believed EVERYTHING is sacred from the largest mountain to the smallest plant and animal. A lesson can be found in all things and experiences and everything has its own purpose. Native Spirituality; is about honor, love, and respect. Not only do they love, honor, and respect our Creator and Mother Earth, but also every living thing. They are in touch with themselves and everything around them. It is about knowing and understanding that they were a part of everything, and everything is a part of them. Native Americans valued many things like animals; buffalo, deer, and small rabbits. Meat could be cooked fresh or smoked, and stored for long journeys or winter months. They also ate vegetables and plants; berries, squash and fruits. They valued God because he created everything. Some tribes believed in one or many gods whom more powerful than others. Shamans were religious people who had close contacts with spirits. They were often medicine men and treated sick people . There is no power greater than the Natural Laws. These powers were set up by the Great Spirit in a way that the human being has no access to it, except by obeying. If they choose not to follow the Natural Laws, their life will be filled with confusion, tension, anxiety and stress. If they were to poison the Earth, they would poison themselves. If they were to poison the Water of the Earth, they were to poison themselves. What they would do to Earth, would happen to them and their children, even the children that were unborn.

Response to literature- black snake: the daring of Ned Kelly Essay

Bushrangers are known to be ruthless outlaws. Many people have thought of Ned Kelly as a villain, some think of him as a hero or possibly a victim in most cases. Ned Kelly has committed various villainous acts or has been a part of scenes where he most likely wasn’t supposed to be. However, Ned has also done heroic acts and has been victimized by numerous Victorians at the time. Ned Kelly had been expected to be a villain since a young age. Young Ned had done many things a twelve year old wouldn’t think of committing, such as robbing a bank. Ned was originally sentenced to an unexpected trial because he was caught by a trooper when he was flashing a horse in the local streets of Greta. Apparently, Ned thought the horse he was riding belonged to a friend of the family who left not long ago but the horse was actually stolen. Ned had explained to the judge that he didn’t know that the horse was stolen. Unfairly, the judge charged Ned for receiving a stolen horse and was sentenced to three years of hard labor. As for the family friend who stole the horse, he was sentenced to only six months of hard labor. Many Victorians thought that he deserved it, although, I believe he was highly victimized at the scene of the trial. Ned had always been highly protective of his family. There was a scene that happened at the Kelly’s house between a trooper that spread everywhere in Victoria. A fellow constable had arrived drunk at the Kelly’s doorstep to arrest Ned’s brother Dan who was accused of horse stealing. Later on, the constable started to act inappropriately towards Ned’s sister Kate. Ned’s mother got a hold of a shovel and dented the constable’s helmet. After the crime scene, a trial for the incident occurred and Ned’s mother had to serve three years of hard labor until someone pays the bailing payment. Ned, Dan and two mates of theirs formed a fugitive gang and robbed banks and did obscured acts to pay the bail money. Many different stories have been recorded. This may be a villainous and slightly idiotic thing to do but some may think it is loyal and heroic. There was one incident that made all Victorians turn on Ned. There was a shooting at Stringybark Creek where the Kelly gang had their hideout. The results from the shooting scene left two women widowed and nine children fatherless. Since then, there had been an increasing reward for the find of the Kelly gang. Despite all the villainous acts stated, Ned Kelly was victimized through many events. All his and his family’s trials were unfair due to biasness. Victorians judged the Kelly family and no one listened to their point of view. Ned Kelly stated that the incident at Stringybark Creek was a misunderstanding and that they never planned to shoot. As for the incident at the Kelly house, Ned Kelly was never at the crime scene and was believed to be four hundred-six hundred miles away. It was that the constable was shot by Mrs. Kelly herself but tended the wounds. When the constable went back to the station, he had told the judge, fellow Victorians and partners that is was Ned who shot him. Nevertheless, the judge charged Mrs. Kelly for three years of hard labor and since then, Victorians had been on the hunt for the Kelly’s. Through many of Ned Kelly’s past events, due to all reasoning and evidence stated, it is quite clear that Ned Kelly was put through many crime scenes that he and his family were victimized in.

The importance of the business educators is increasing as the business world becomes more complex. Through this program, the students are educated to become skilled individuals who can contribute meaningfully to the overall effectiveness in an office setting, teaching and learning in schools. According to Hornby (2006) he says, â€Å"Curriculum is a subject that is included in a course of study or taught in a school, college, etc.† On the other hand, Uwaifo (2006) stated that a close look at the current Vocational and Technical Education curriculum generally reveals some problems that border on inadequate course content. Uhumuavbi and Ebhomhen (2006) in their own vain statement, they said that irrespective of the level of education and training given during the pre-colonial days in Africa, it was functional because the curriculum was relevant to the needs of the society. Unemployment if it existed, at all was minimal and very few young men roamed the villages and towns with nothing to do. According to Snyder (2008), a flexible curriculum is important because there is no single curricular path to career success. We are giving students more flexibility; this is not a radical departure from our curriculum. While Robert and Booth (2008) stated that the curriculum changes allow students to increase the intensity of their studies. According to Hasan (2001) the current status of the Indonesians educational system is somehow affected by current academic performance, curriculum, and quality of teachers and level of education. The policy directions for curriculum development were very positive and there was a lot of challenge for the Ministry of National Education to follow-up in the implementation of policies formulated, design a curriculum that includes technological system and information system to uplift the academic  performance in every level of education. Updating of the physical facilities is needed to improve teaching and learning process. Wagan (2001) stressed that continuous evaluation of the school curriculum should not be overlooked. Time and development in the business call for change and modification. The suggestions of graduates maybe a rich source of information for authorities, curriculum makers and in-service training program coordinates for materials that need emphasis and innovations. The National Association for Business Teacher Education (NABTE) is the institutional division of NBEA. The primary purpose of the organization is to promote business teacher education by providing national leadership and services to its member institutions and business teacher educators. Membership is open only to such colleges and universities that offer business teacher education curriculums approved by their respective State Departments of Education for the certification of business teachers. NABTE highlighted the importance of professional development in its publication, Business Teacher Education Curriculum Guide & Program Standards (2011). It emphasizes that business teacher educators should be involved in continual professional development activities and highlighted the importance of the course itself for future reference. The education paradigm emphasized during the early part of the 21st Century clearly called for an emphasis on basic skills (No Child Left Behind, 2001). The term â€Å"basic skill† is widely recognized as skill in reading, writing, or math. In fact, the United States national assessment of educational achievement assesses students in two basic skill areas: mathematics and reading. The term reading refers to the ability of a subject to phonemically announce and comprehend written or symbolic material. A licensed teacher is even highly regarded, according to the No Child Left Behind Act 2001, â€Å"highly qualified means that teachers have passed the teacher licensing examination.† (Tileston, 2004, p. 8). Foreign Studies Earlier research studies into the professional development needs of business teacher educators felt they needed more preparation in the development of new teaching methods; it seemed to echo the same perception of practicing business teachers (Polkinghorne, 2006). As a result, Boatright (2005) reported that all teachers must receive â€Å"adequate preparation† to work with  an â€Å"integrated curriculum†. Most teacher education programs use students’ grade point average (GPA) as a criterion for admission (Mikotovics & Crehan, 2002). Some programs combine GPA with ratings of a written profile, which requires applicants to describe relevant experiences and why they are interested in teaching or with letters of reference (Caskey, Peterson, & Temple, 2001) or with ratings of applicants’ performance in an interview (Denner, Salzman, & Newsome, 2001). In the United States, standardized test results are commonly used. Results from specific pre-requisite education courses also may be utilized. Finally, for applicants intending to become high school teachers, most consecutive programs require university-level coursework in the subject areas to be taught. Grade Point Average. It is generally believed to measure academic ability and so is thought to predict success in the instructional parts of the programs. However, a more important reason for its popularity as a criterion is likely its ready availability from students’ transcripts and its use by other advanced degree programs. Written Profile. The second most widely used criterion for entrance into teacher education programs is an applicant profile, typically consisting of written responses to specific questions about relevant experiences and interest in teaching. Such a profile includes much of the same information that could be elicited in an individual interview. The responses may be reviewed by the teacher education program for evidence of appropriate preparation and genuine interest and for evidence of unsuitability for teaching (Caskey, Peterson & Temple, 2001). In Ontario, all but one teacher education program uses some form of profile or essay response for screening applicants (Teacher Education Application Services, TEAS, 2004). Interview. The interview provides a unique opportunity for the teacher education program to gather information about an applicant’s language proficiency, attitudes, and interpersonal skills, in addition to information similar to that which could be gleaned from a written profile (Denner et. al., 2001). Interview ratings have also been found to be of limited value for predicting student teaching performance (Byrnes et. al., 2000; Caskey et. al., 2001; Denner et. al., 2001). However, they found that ratings of applicants’ performance in a  group interview predicted student teaching performance and that this type of interview was a better predictor than academic criteria. More recently, Byrnes, Kiger, and Shechtman (2000) studied 65 pre-service teachers, comparing their university supervisors’ and supervising teachers’ ratings of their student teaching performance with their ratings from a group interview intended to assess applicants’ verbal, interpersonal, and leadership skills. The group interview ratings added significantly to the prediction of the university supervisors’ ratings of the pre-service teachers’ student teaching performance, after controlling for the contributions of GPA and ACT test scores, but not to the prediction of the supervising teachers’ ratings. Standardized Tests. Many teacher education programs in the U.S. use results from standardized tests in their selection processes. For example, 28 states and the District of Columbia require applicants to pass the Praxis I: Pre Professional Skills Assessments (Educational Testing Service, 2006), which tests basic skills in reading, writing, and mathematics knowledge. There does not appear to be a consistent protocol for the use of or selection of standardized tests in the United States, and none are used in Canada as the mandate for Education falls under the jurisdiction of provincial governments. Courses in Subject Area. Applicants for consecutive programs who wish to train to be elementary school teachers are often assumed to have adequate subject matter knowledge if they have a Bachelor’s degree (although some programs will require them to also pass tests of reading, writing, and mathematics). Applicants for preparation as high school teachers, however, typically must provide proof of adequate knowledge of the subject areas they intend to teach. Often, this requirement is met by providing a university transcript showing completion of the required numbers of courses in the specialization areas. More recently, Stotsky (2006) has suggested that the content of the course should be considered and that university academic departments should be held responsible for the content knowledge of elementary and high school teachers in their disciplines. Overall Success in a Teacher Education Program. A few studies have examined the ability of admission criteria to predict overall success in a teacher education program. Caskey, Peterson, and Temple (2001), for example, analyzed the admission data for 82 applicants who were subsequently admitted to a one-year consecutive teacher education program. They found  that ratings of reference letters and a writing test score were most highly correlated with overall program performance. The correlation has the GPA of: 11 with personal statements, 16 with the performance of problem-solving by group, and with a holistic rating of completion application with .03 GPA. Together, the six admission criteria accounted for 38% of the variance in program performance. Hamel and Merz (2005) indicated the potential positive impact on student achievement emphasized through legislation seemed â€Å"reasonable enough† (p. 158). In fact, they indicated that teacher education institutions should work with federal policy makers to find the best way to improve student achievement. A myriad of social science researchers indicated subject-matter knowledge is an important component of effective teaching (Draper, 2008; Kehe, 2003; Stone et. al., 2008). A teacher’s ability to contextualize abstract content-knowledge to authentic learning opportunities is essential to the student’s ability to retain and apply knowledge to unique situations. Contextualizing subject-matter knowledge in social context is supported in both content area reading and cognitive research. Early content area reading research focused on students’ ability to pronounce written materials. To achieve this, according to the National Policy on Education (2004), computer education was integrated into the primary school curriculum, a welcome development but sad to note that subjects like shorthand, typewriting, commerce, and book-keeping are integrated together to form business studies thereby losing their original identity. Local Literature In the growing demands of today’s modern world one should be aware of the striking challenges and complexities of life today. Being aware of these things can do a big contribution in terms of the development of the society as well as the citizen of the society. The test of the greatness of a nation lies on the quality of education of its people. Thus, education plays a vital role in developing and producing locally and globally competitive citizens. On the other hand, if Business Teacher Education program are aiming for quality education and successful teachers, they should consider the effectiveness of the courses and programs being offered as well as the competencies of the teachers in transferring the knowledge and skills to the  future educators of the country. While various schools and other institutions offering business teacher education are having difficulties on improving the performance rating of the graduates in the licensure examination for teachers, it is very interesting to know the admission policies of the schools and the quality of the business teacher education program in producing competitive educators of the country. On the article of Vea Reynaldo (2009) discussing about the World education news and reviews, she made mention about the Philippine educational system. She said that entrance to universities and other institutions of higher education is dependent on the possession of a high school Certificate of Graduation and in some cases on the results of the National Career Assessment Examination (NCAE), or in many colleges and universities the results of their own entrance examinations. The NCAE is administered to fourth-year high school students to gauge the quality of the individual institutions they are attending, it was not designed or intended as an admission test, but has nonetheless served that purpose for some institutions and helps students to choose their career paths. Privately administered testing programs through the Center for Educational Measurement (CEP) are also widely used by colleges for admissions purposes. The two most common ones are the College Scholastic Aptitude Test (CSAT) and the Admission Test for Colleges and Universities (ATCU). The Philippine Education Placement Test (PEPT) is a national examination designed to evaluate the grade level of students returning to the school system or seeking admission to college based on knowledge and skills gained through formal and non-formal methods. Paredes (2000) states that the task of universities, colleges, and other educational institutions engaged in teacher education is to produce teachers whose preparation allow them to possess not only a high degree of technical skills and a thorough education underlying the practice of teaching, but also to become persons qualified to assume the responsibilities of educational leadership in the communities in which they will work. Enriquez, (2000) gives importance on accepting students engaged in Teacher Education Program who would unselfishly devote their lives to the noble task of teaching, which the researchers think will do a great help in producing competent teachers that will help students to  become a productive citizen of the country. The admission policy at Polytechnic University of the Philippines on the year on school year 2011-2012 is on a FIRST-COME-FIRST-SERVED basis subject to the availability of slots. In addition to the general criteria set by the University, admission to an academic program depends on the satisfaction of the specific criteria such as PUPCET Score, High School General Weighted Average and High School final rating requirement in selected HS subjects.) In the College of Education, the specific criteria in admitting aspiring students should have a minimum PUPCET score of 99, on the high school general weighted average their minimum requirement is 82% and the final rating in the English subject should be 82%. The students should pass also in the final interview to be admitted at the College of Education. According to Basaen, et. al. (2005), he wrote about the results of licensure examinations have become measures of the quality of instruction, faculty, and students. Accrediting agencies as well as C.H.E.D. have used government board examination results as gauge in granting schools the university status, center of development, and center of excellence. Moreover, on the results of the licensure examination for teachers at the Polytechnic University of the Philippines from the year 2008-2013 the researchers had gathered. It had been showed from year 2008 that overall results were 63%, wherein 91 out of 144 passed the examination. While on the year 2009, the overall results were 56% wherein 267 out of 479 had passed. On the year 2010 there are 141 who passed out of 359 examinees equivalent to 39.25%. While on the year 2011, the overall results were 40.86 wherein 143 had passed out of 350. On the other hand, on year 2012 the overall results was 72.69% where in 330 out of 454 had passed the examination. Lastly, on the current year 2013, the results decreased from 72.69% to 60.33% wherein 146 had passed out of 242. Thus, there is varying results on the performance rating of the students at the Polytechnic University of the Philippines. It only goes to show that there is still a need of an improvement. Local Studies Licensure examination is a scholastic aptitude test designed to measure some intellectual abilities and skills and that will serve as a requirement for eligibility in the teaching profession. It is the last hurdle that a  candidate must face to acquire a license to work. A board has the ultimate responsibility to ensure that the examination meets the technical, professional, and legal standards, and protects the health, safety, and welfare of the public by assessing candidates’ abilities to practice competently in their chosen field. According to Ornstein and Levine (2006, p. 28) licensure and testing for teachers is one of the steps that improves public confidence in the teacher workplace. Panawidan (2000) found in her study of The Status of the Teacher Education Program of Higher Education Institutions in Region XII that the enrolment in Teacher Education was relatively high compared to other disciplines. She said that teacher education programs are found to be oversubscribed including courses in Business Education, Humanities, Social Sciences and Communication. There seemed to be resurgence in the demand for teachers here and abroad. She also said that teacher education program was well implemented by majority of the teacher education institutions because of compliance to CHED requirements. In addition, results showed that there were more LET passers in the elementary level than in the secondary level. There are several factors which could influence the performance of higher education institutions that are offering teacher education program. According to Tan C (2006) in her study of the Factors influencing the performance of teacher education program in selected state universities and colleges in Region IV-A, some faculty-related factors and dean-related factors influenced the performance of teacher education programs in terms of passing rate in the LET and employment rate of graduates. Supervision of the deans indicated by the dean’s activities towards the improvement of classroom instruction and dean’s supervisory practices for the development of better school and community relationship had significant and positive effect on the passing rate. The more often the deans did such activities, the higher was the passing rate in the LET. Another factor was the school climate since a good school climate results to higher passing rate in the LET, although this condition had a negative influence on the employment rate. The dean’s longer years of teaching resulted to lower passing rate in the LET but the dean’s education attainment positively influenced the employment of the graduates. Layba (2003) conducted his study on Evaluation  of the Quality Teacher Education Program in Higher Education Institutions in the Province of Laguna which consisted of 13 privates and public tertiary schools for school year 2002-2003. In his study, the researcher involves the administrators and teachers of selected tertiary schools as respondents. The results revealed several strengths and weaknesses of the education program among school respondents. According to Limo (2010) on his study about the Need-based Reviewer in Technology and Livelihood Education for the licensure examination for teachers, it is concluded that the reviewer in T.L.E. is a useful materials in preparing education graduates whose major are technology and livelihood education to take the LET. LET-T.L.E reviewer prepares graduates in the LET in the different components they are not trained in. It has a content update in each component or practice test items that guide the target user on how to identify the correct answer. Moreover, the reviewer was found highly valid as to objectives, contents, instructional materials and practice test items; hence they are expected to be able to assist the TLE graduates to pass the LET. Valenton and Dela Cruz (2007) found on their study about The â€Å"Performance in the Licensure Examination for Teachers (LET) of Bachelor of Secondary Education Major in Technology and Home Economics Graduates at Nueva Ecija University of Science and Technology†, the batch passing rates of LET takers from 2003-2006 were all lower than 30%. Also, the LET takers had a satisfactory performance only in the Field of Specialization and did not perform well in the General Education and Professional Subjects. It might be implied that the BSE Graduates major in T.H.E. did not perform well the LET given in years 2004 to 2006.
